His current book project analyzes new global governance structures created to institutionalize Earth Law in order to alter the way we practice sustainable development and address climate change. The project analyzes the global Rights of Nature movement and its effort to incorporate rights of nature into laws and institutions at both the domestic and international levels. Michelle Bender: Advancing Holistic and Ocean Rights-Based Governance

To better address the pressing environmental challenges of today, ”Earth Law” – an emerging form of governance – provides legal rights to nature and gives a stronger voice to local communities and indigenous groups in decisions that impact the environment. The talk will provide a background and overview of Earth Law Center (ELC), a legal advocacy group working to transform our governance systems to include rights of nature. Michelle Bender is the Ocean Rights Manager at ELC, committed to incorporating the rights of nature into ocean law and policy. Michelle will provide an overview of ELC’s Ocean Rights initiatives and strategies, evaluate current ocean protection efforts, and delve into what a holistic and rights-based approach would look like in practice. Hugo Echeverría: When Courts meet the Wild. The case of Nature’s rights in EcuadorTen years ago, Ecuador recognized Nature as a subject of constitutional rights. Ten years is not much in legal terms. Nevertheless, is it enough time to preliminarily assess what has happened to enforcement of rights to Nature. The talk will provide a background and overview of the Ecuadorian recognition of rights to Nature and will focus on application of these rights in specific cases, at Courts. It will address the lessons learned as well as the challenges ahead. The talk will make a special reference to rights of Nature in a ¨blue context¨, that is, issues related to the ocean and marine wildlife. Hugo Echeverría is an Ecuadorian lawyer with over 17 years of practice in Environmental Law. Since 2007 Hugo has been studying the recognition of rights to Nature and its effects on law enforcement.

30 nov: International Tribunal on the Rights of Nature, reflektioner från Bonn
I början av november hålls the International Tribunal on the Rights of Nature i Bonn. Tribunalen utgår ifrån att Deklarationen om Naturens Rättigheter är omsatt i lagstiftning. Svenska juristerna Mariam Carlsson Kanyama (End Ecocide Sweden/on Earth) och Stina Bagge (Earth Law Center) är på plats i Bonn och berättar under denna kväll om hur det var. Hur erkänns naturens egenvärde på olika nivåer i existerande juridiska ramverk? Vilka principer som talar för Naturens rättigheter behöver införas för att uppnå de mål som EU och Sverige eftersträvar? Stina Bagge läser kursen European Environmental Law på Uppsala Universitet och berättar ikväll utifrån sin uppsats om Naturens rättigheter i såväl svensk och EU-rättslig belysning. Stina har sedan i juni 2017 arbetat för Earth Law Center i Kalifornien med att konstruera ett regelverk för marina skyddsområden där dessa ges juridiska rättigheter, vilket presenterades på IMPAC4 i Chile i september 2017.

Bolivia är en föregångare för naturens rättigheter med den första nationella lagstiftningen för Moder Jords rättigheter. Livsfilosofin Buen Vivir eller Sumak Kawsay har skrivits in i konstitutionen och innebär en alternativ utvecklingsmodell byggd på harmoni och balans, där människan inte förbrukar mer än hon behöver, där djur och natur respekteras i samma utsträckning som människor och där besluten styrs av vad som är bäst för alla. Hur ser det ut i praktiken? Går vision och verklighet ihop? 27 okt: Harmony with Nature – FN:s initiativ för naturens rättigheter
FN höll i våras en dialogprocess för naturens rättigheter under rubriken ”Harmony with Nature”. Fokus var att hitta sätt att omskapa system för mänsklig styrning (governance) så att de utgår ifrån att Jorden, inte människan, är i centrum. Henrik Hallgren och Pella Thiel från Lodyn som deltog i initiativet presenterar den rapport som överlämnades till FN:s generalförsamling i september. www.harmonywithnatureun.org

1 dec: Local action for the rights of ecosystems – a democracy issue
Over 200 local communities in the US have created local ordinances to grant rights to ecosystems and communities, rights that takes precedence over corporate rights to exploit. Community Environmental Legal Defense Fund, CELDF, have been part of most of these cases. Mari Margil from CELDF explains through Skype how they work, followed by a discussion on implementation in Sweden. Mari was also part of developing Ecuadors constitution and a political platform for the rights of nature together with the Green Party i England och Wales. www.celdf.org
